How to register a Trademark in India ?

A trademark is a word, phrase, symbol, or design that is used to identify and distinguish the goods or services of one party from those of others. Registering a trademark gives you the exclusive right to use the mark in relation to the goods or services specified in the registration.

To register a trademark in India, you must file an application with the Indian Trade Marks Registry (TMR). The application must include the following information:

  • The trademark you wish to register
  • The goods or services that the trademark will be used for
  • The date on which you first used the trademark
  • A declaration that you are the owner of the trademark

You can file an application for trademark registration online or at any of the TMR's offices. The application fee is INR 1,500 for each class of goods or services.

Once your application is filed, the TMR will conduct a search to see if there are any other trademarks that are similar to yours. If there are no conflicts, your application will be published in the Trademark Journal. This gives other people the opportunity to oppose your application.

If there are no objections, your trademark will be registered and you will be issued a registration certificate. The registration will be valid for 10 years and can be renewed for further periods of 10 years each.
